"I can walk away from my house without a mortgage on my credit?
I filed for Chapter 7 bankruptcy in 5.10. I was discharged in 06.03. I presented in the old bankruptcy laws. Well my attourney apperentely there is no law and practice I had never filled out the paperwork to keep redemption my house. I never missed a payment, even during bankruptcy with all good intentions to keep my home. Well last month I went to qualify for a new house and sell the current home. I learned that Wells Fargo was not reporting my credit bearau! NIGHTMARE! Because they are not reporting that does not have a loan to buy a new home. Called Wells Fargo, not going to help me said all I can do is to refinance to get back home in my name. Now I am so frustrated I just want to go back and forward. I can do it legally and do not receive the residence during my bankruptcy? I am located in Dallas, Tx. The mortgage is shown as discharged through bankruptcy for my credit.
David, I hate to say this — but you have to get a bankruptcy attorney to deal with this disaster. Explain your situation to the new lawyer (including history behind the former attorney). Are you sure Wells Fargo made the mistake (failing to inform a credit bureau )?— inclined to believe me — but it's a new one. But … as some people say "the truth is often stranger than fiction sometimes (I've heard some horror stories from within the mortgage business — Most of which relates to management incompetence and greed). I feel for you man — good luck to you.
